HIV and assisted living in Ark

Lambda Legal, a national group that advocates civil rights for gays and those with HIV, says it plans to sue a North Little Rock assisted-living facility for evicting a man infected with the virus that causes AIDS.

A news conference is scheduled Tuesday morning in Little Rock. Lambda Legal spokesman Jason Howe declined to name names today. But Howe says the case involves a 75-year-old retired university provost and minister who moved to Arkansas to be near his daughter.

Howe says they found an assisted-living facility near her home and the man was accepted to live there after submitting papers from a doctor advising he was HIV positive. But after the man moved in in the morning, his daughter received a telephone call that same afternoon “saying he had to be out of there.”

Howe says the lawsuit, alleging discrimination under the federal Americans with Disabilities and Fair Housing acts, is to be filed prior to Tuesday’s news conference scheduled for 10 a.m. at the DoubleTree Hotel.
